A writ petition has been filed in the Supreme Court challenging the Tamil Nadu Governor’s delay in inviting C. Joseph Vijay to form the government, asserting that the Governor’s May 7 press release, which denied Vijay’s claim, is unconstitutional and arbitrary. The petitioner, retired IPS officer M. Ramasubramani, argues that the Governor’s refusal to invite Mr. Vijay, who leads the single largest party following the 2026 Assembly elections, undermines parliamentary democracy. The petition emphasizes that the demand for Mr. Vijay to demonstrate majority support before being invited sets a harmful precedent.

The petition contends that the Governor’s insistence on a demonstration of “requisite majority support” stands in direct contradiction to established constitutional conventions governing government formation in hung Assemblies. It asserts that such requirements effectively obstruct the democratic process by precluding the party from showcasing its majority on the Assembly floor. Ramasubramani highlights that determining a political party’s majority support is a matter for the Legislative Assembly, rather than a prerogative of the Governor.

Additionally, the petition references an earlier claim submitted by Ezhilarasi P., a TVK party member, who similarly argued that the Governor has an obligation to invite the leader of the largest party to form the government, allowing them to prove their majority subsequently. This ongoing challenge underscores the tension between constitutional authority and political maneuvering, as the petitioners seek to reaffirm the necessity of adhering to democratic processes in Tamil Nadu’s governance.
