Sebi and CBDT Streamline PAN Regulations for Foreign Investors Amid Onboarding Challenges.
The capital markets landscape in India is witnessing a positive shift as the Securities and Exchange Board of India (Sebi) and the Central Board of Direct Taxes (CBDT) have announced eased compliance requirements concerning Permanent Account Number (PAN) for Foreign Portfolio Investors (FPIs). This decision comes after stakeholders highlighted the complexities associated with the newly implemented income-tax rules and revised PAN application forms. The adjustments aim to facilitate smoother onboarding for foreign investors, thus enhancing India’s attractiveness as an investment destination.
Recent clarifications from the CBDT serve to simplify the PAN allotment process. Notably, the name of the authorized signatory listed in the Common Application Form (CAF) will now suffice for the fields related to representative assessees. Furthermore, the liability of the authorized signatory will be confined to the PAN application process itself, with no additional documentation required. These amendments respond directly to concerns raised about the difficulty of meeting various jurisdictional requirements, ultimately aiming to create a more efficient and user-friendly PAN issuance framework for FPIs.
Additional relaxations include provisions for addressing contact-related compliance issues, allowing FPIs to substitute their own contact information if that of the authorized signatory is unavailable. The revised guidelines also offer a workaround for cases where taxpayer identification numbers (TIN) are not applicable, enabling applicants to input a designated placeholder. Overall, these measures reflect Sebi and CBDT’s commitment to creating an accessible environment for foreign investments, particularly as FPIs navigate multiple regulatory processes through a single Common Application Form, which encompasses Sebi registration and various account management tasks.
