OPT Fraud Alert: 10,000 Foreign Students, Including Thousands of Indians, Under U.S. Immigration and Customs Enforcement Investigation
ICE has identified 10,000 foreign students, including many from India, who are allegedly misusing the Optional Practical Training (OPT) component of their student visas to work for questionable employers. This program enables foreign nationals to work in the U.S. for 12 to 24 months after graduation, but its integrity has come under scrutiny. Acting Director of ICE, Todd Lyons, stated that the OPT program has turned into a “magnet for fraud,” leading to investigations by the Department of Homeland Security (DHS).
Lyons highlighted a concerning range of criminal activities linked to these cases, including espionage, biological threats, intellectual property theft, and various forms of fraud. Investigations have revealed instances where OPT beneficiaries are being managed by foreign companies, violating the program’s requirement for U.S.-based training and oversight. This misuse of the program underscores a significant security risk associated with foreign student placements in the workforce.
The expansion of the OPT program, initially designed to serve a limited number of students, has led to a surge in foreign workers in the U.S., raising alarms about the program’s current administration. Lyons stated that the rampant fraud represents a blatant violation of the trust placed in foreign nationals by American citizens, who support their participation in the U.S. education system. As allegations of exploitation and misuse grow, federal regulators are likely to pursue stricter oversight and reform of the OPT framework.
